In yet another attack on business by the Obama Administration, the Equal Employment Opportunity Commission is suing Dollar General and BMW America, claiming that conducting background checks for a criminal past on potential hires amounts to discrimination.
The EEOC claims that even though the companies were following existing law, which requires them to do the checks, they used the information in considering hires, thus it is racist because a majority of those with criminal records are black or hispanic. The EEOC says the policy has a "disparate impact" on minorities and causes a disproportionate number of blacks to be screened out of jobs due to their criminal records.
Well, duh! My dad told me a long time ago that there are consequences to my actions, and that some of those could have negative impacts on what I want to do in life. He used to say, "You can have a thousand 'atta boys', and it only take one 'aw sh*t' to cancel them all out". And that one screw-up can affect you for years, or even decades. Regaining trust, once broken, is a difficult thing to recover. You can say "it isn't fair", and maybe it isn't always fair, but it is reality. The person that breaks a trust has to work ten-fold to turn that impression around. Well, enough of my rant.
In this case, the EEOC is going after employers who are following the law, yet are still being harrassed by an overreaching and ham-fisted federal government. On the one hand, the government says that the companies must do the checks, while on the other they say to discount what the checks may discover, Worse, they are essentially saying that if a person has a criminal record they should be moved to the top of the list to eliminate the "appearance" of discrimination.
The federal government can't have it both ways. If they don't hire a person based on a criminal record, they open themselves up to being sued for discrimination. If they do hire the person, and that person steals from the company, or has an incident of workplace violence, the company opens itself up to loss of assets, or to litigation from its employees for hiring a known felon.
The Obama Administration continues its hostile, jack-booted march on the private sector,

NLRB To Force Businesses To Turn Over Workers Private Info To Unions?
Posted by Brian
The National Labor Relations Board (NLRB) is said to be considering a rule that would affect 97% of private business in the country. That rule would require that non-union businesses must provide the names, phone numbers, e-mails, and even work schedules to union organizers, presumably making it easier for union to organize non-union shops.
This would be an outrage! Is this the Soviet Union?! Are the unions now just another arm of the federal government and the Democrats? The answer is: Yes. Especially as Barack Obama and his marxist thugs see it.
Remember, this is the same NLRB who filed a lawsuit against Boeing to prevent them from building a 737 MAX jet at its plant in South Carolina, instead of Washington State. The reason? South Carolina is a "right to work" state. That is, it is non-union. For Boeing, the move made financial sense, as the costs of building the planes in South Carolina would be significantly lower. This didn't sit well with the Boeing employees in Washington, who along with the NLRB, filed suit. Boeing eventually agreed to keep the production in Washington, the result of strong-arm tactics by a politicized agency packed with Obama leftists, which included former SEIU attorney Craig Becker (now with the AFL-CIO).
It is premature to say that this is a done deal, but nothing from this administration should be dismissed lightly. This type of invasion of privacy by the Obama Administration, especially with their extremely close ties to the AFL-CIO, SEIU, and the Teamsters, is entirely believable. In fact, it's entirely consistent with his whole policy and ideology.
Stay tuned!

*UPDATED: November 15, 2012–Now that the re-election of Barack Obama has taken place, this is back on the table.
President Barack Obama’s National Labor Relations Board (NLRB) is considering a rule that would force private businesses to turn over their workers’ personal information — such as phone numbers, email addresses, and work schedules — to union organizers.
While this rule would be intended to make it easier for union bosses to organize workers at businesses that do not have a union presence, it would also have the unintended effect of making workers vulnerable to harassment.

Obama: "Private Sector Is Fine", 122K Workers Laid Off
Posted by Brian
H/T Michelle Malkin
122,000 people laid off in September (Bureau of Labor Statistics - Mass Layoffs). I guess these are the hors d'oeuvres leading up to the main course of layoffs. Already we are seeing companies who are reporting mass layoffs, shifting jobs overseas, or both (Mourning In America - Here's the layoffs we voted for last night)
Funny. I don't remember this being mentioned by the mainstream media anywhere in the weeks leading up to the election. Obama even spoke of how the private sector is doing "just fine", both on the campaign trail and in the debates. I must have missed it when Candy Crowley corrected Obama on this.
But, don't worry. The private sector is just fine.
You were warned: Obama’s layoff bomb goes BOOM!

This is just the beginning.
In case you missed it, Boeing announced massive layoffs and facilities closures yesterday.
More: Small business owners are dropping the axe as they brace for the costs and burdens of Obamacare.
In case you missed it, I reported on Obama’s layoff bomb last week.

In June, a diffident and self-deluded President Obama claimed that “the private sector is doing fine.” Last week, the private sector responded: Speak for yourself, buster. Who needs an “October Surprise” when the business headlines are broadcasting the imminent layoff bomb in neon lights?
The Bureau of Labor Statistics reported last Tuesday that employers issued 1,316 “mass layoff actions” (affecting 50 workers or more) in September; more than 122,000 workers were affected overall. USA Today financial reporter Matt Krantz wrote that “(m)uch of the recent layoff activity is connected to what’s been the slowest period of earnings growth since the third quarter of 2009.”
Some necessary restructuring is underway in response to the stagnant European economy. But more and more U.S. businesses are putting the blame — bravely and squarely — right where it belongs: on the obstructionist policies and regulatory schemes of the blame-shifter-in-chief.

DOJ to Colorado Family: Give Up Your Religion or Your Business
By Terence P. Jeffrey July 26, 2012
(CNSNews.com) - The Justice Department last week presented the Newland family of Colorado--who own Hercules Industries, a heating, ventilation and air-conditioning business--with what amounted to an ultimatum: Give up your religion or your business.
“Hercules Industries has ‘made no showing of a religious belief which requires that [it] engage in the [HVAC] business,” the Justice Department said in a formal filing in the U.S. District Court for the District of Colorado.
