Dems Release False Report on Fast and Furious

Posted by Brian
Senator Charles Grassley says report doesn't "pass the laugh test."

Ranking Member Elijah Cummings and other Democrats in the minority of the House Oversight and Government Reform Committee have made an attempt to whitewash apparent felonies committed by the Department of Justice during Operation Fast and Furious:

Democrats looking into Operation Fast and Furious say a yearlong investigation has turned up no evidence that the flawed gun smuggling probe was conceived or directed by high-level political appointees at Justice Department headquarters.
The probe, the Democrats say, was just one of four such operations that were part of a misguided five-year-long effort, during both the George W. Bush and Obama administrations, in the Phoenix division of the Bureau of Alcohol, Tobacco, Firearms and Explosives against firearms trafficking along the Southwest border.
“Operation Fast and Furious was the latest in a series of fatally flawed operations run by ATF agents in Phoenix and the Arizona U.S. Attorney’s Office,” the report from Democrats on the House Oversight and Government Reform Committee says.

Senator Charles Grassley, who has helped lead the investigation of the gunwalking plot, reacted angrily to the minority report:

Fast And Furious Update: Holder Justice May Have Violated Two Major U.S. Laws

Gunwalker: Justice Dept. Violated U.S. Laws Beyond Those Being Investigated

I know, because I was the principal drafter of some of the legislation.
by
JAMES K. STINEBOWER

As we continue to watch the general uproar over the Operation Fast and Furious program, and specifically what Attorney General Holder knew and when he knew it, it needs to be noted that perjury is not the only apparent violation of law to have occurred.
I refer to the apparent violation of at least one (probably two) major U.S. laws by the Holder Justice Department. A few years ago, the International Emergency Economic Powers Act (50 U.S.C. 1701, the follow-on to the Trading with the Enemy Act) was expanded in order to criminalize any transactions between U.S. entities — to include departments and agencies of the U.S. government — and all foreign drug cartels.
I am familiar with these prohibitive statues because several years ago, while serving as the senior drug analyst for the Senate Intelligence Committee, I was tasked to initiate and became the principal drafter of legislation which became known as the Kingpin Act (21 U.S.C. §§ 1901-08). The Kingpin Act is an extension of the highly successful IEEPA sanctioning program specifically targeting Colombian drug cartels. It expands sanctions authority against various drug cartel operations worldwide — including Mexico — which have been determined by the president to be threats to the national security, foreign policy, or economy of the United States

Holder: No Apology For Agents' Death As A Result Of Fast and Furious Operation

Posted by Brian
Agent Bryan Terry is killed in cold blood. Weapons at the scene are weapons sold and allowed to walk across the border as part of operation "Fast & Furious".  But' there is no connection, according to Eric "Stedman" Holder.  Just as there was no evidence of the New Black Panthers intimidating voters at polling places in Philadelphia in 2008, a case which Holder's Justice Department failed to pursue for lack of evidence.  This administration are some stone cold SOB's.

No Apology: Holder Says ‘Not Fair’ to Assume Fast and Furious ‘Directly’ Led to Border Agent’s Death

(CNSNews.com) – Attorney General Eric Holder declined the chance to apologize to the family of slain Border Patrol agent Brian Terry, who was killed in December 2010 and where, at the crime scene, at least two of the firearms recovered were traced to the Justice Department’s botched gunwalking program, Operation Fast and Furious.

“I certainly regret what happened to agent Brian Terry. I can only imagine the pain that his family has had to deal with. I’m the father of three children myself,” Holder told the Senate Judiciary Committee on Tuesday. “It pains me whenever there is the death of a law enforcement official, especially under the circumstances that this occurred. It is not fair, however, to assume that the mistakes that happened in Fast and Furious directly led to the death of agent Terry.”

Fast and Furious: Supervisors Were Promoted Following Whistleblower Complaints

Posted by Brian
Two dead U.S. law enforcement personnel, scores of dead Mexicans and Holder says that the "gun walking" tactic was "unacceptable", BUT the goal was correct - to "combat gun trafficking and violence" on the border.  So, he is essentially saying that, in hindsight, combating violence and gun trafficking by selling weapons to known criminals and drug cartel members, and allowing them to cross the border, was a dumb idea. Brilliant! The legal intellect of this guy is blinding!  On top of this, the Justice Department and the Dems are using this to push for stricter gun control laws, because guns in the wrong hands are a danger to society. Never mind that it was the government that put the guns in the hands of the cartels and criminals to begin with. Holder should either step down or be impeached from his position as the head of the Justice Department, and a full investigation into his perjuring himself before Congress should be started as soon as possible.

Holder Can’t Name a Single Person Who’s Been Held Accountable for Fast and Furious

(CNSNews.com) – Attorney General Eric Holder, in testimony before the Senate Judiciary Committee Tuesday, could not identify a single Justice Department official who was held accountable for the botched gun-walking program known as Operation Fast and Furious
Sen. John Cornyn (R-Texas) asked Holder, “Can you name me one person who’s been held accountable for this Fast and Furious Operation? Just one in the Department of Justice?”

U.S. Atty. Leaks Document To Smear Fast & Furious Whistleblower

Grassley: Ex-U.S. attorney admits leaking Fast and Furious document

Sen. Chuck Grassley (R-IA)
Former U.S. Attorney Dennis Burke in Arizona, who resigned in the wake of a congressional probe into the Fast and Furious undercover investigation his office oversaw, has admitted leaking a sensitive document about a federal agent who blew the whistle on the gunrunning operation, according to Sen. Chuck Grassley, Iowa Republican.
Mr. Grassley, in a statement late Tuesday, said the leaked document was “deemed so sensitive by the Justice Department that it was not provided to Congress, except in a secured room at department headquarters.”
“Leaking sensitive documents to the press and retaliating against whistleblowers is not good faith cooperation with Congress,” Mr. Grassley said.

Rep. Lankford: Lawmakers Exploiting Failed Gunrunner Operation to Limit 2nd Amendment

Wednesday, July 27, 2011
By Adam Sylvain

(CNSNews.com) – As Congress continues to investigate the failed gunrunning operation “Fast and Furious,” which funneled thousands of guns to Mexican drug cartels that used them to commit crimes, Rep. James Lankford (R-Okla.) said that some lawmakers are using information from that program to start restricting Americans’ Second Amendment rights.

At a Bloggers Briefing at the Heritage Foundation on Tuesday, CNSNews.com asked Lankford, “Regarding Fast and Furious, have you heard Sen. Grassley’s (R-Iowa) comments that he thought this was possibly an effort by the administration to set up a case for restricting Second Amendment rights? And have you seen anything to that effect? And, also, what was the most compelling news that came out of today’s hearing?”

ATF Agent Implicates White House in Gun Runner Operation

White House Staffer Knew About Gun Running Operation Last Fall

Wednesday, July 27, 2011
By Fred Lucas

Washington (CNSNews.com) – At least one person in the White House knew about the Bureau of Alcohol, Tobacco, Firearms and Explosives gun-running operation three months before weapons from the botched sting were found at the murder scene of a U.S. Border Patrol agent.

That’s what a high-ranking ATF official told Congress on Tuesday.

William Newell, the former ATF special agent in charge of the Phoenix field office, told the House Oversight and Government Reform Committee that he communicated with Kevin O'Reilly, a staffer on President Obama’s National Security Council, about Operation Fast and Furious in September 2010.

ATF loses track of 1,400 guns in criticized probe
By Todd Schwarzschild and Drew Griffin, CNN Special Investigations Unit

July 12, 2011 9:14 p.m. EDT

(CNN) -- Federal agents can't account for more than 1,400 guns after a widely criticized operation aimed at tracing the flow of weapons to Mexican drug gangs, sources with knowledge of the investigation tell CNN.

Of 2,020 guns involved in the Bureau of Alcohol, Tobacco, Firearms, and Explosives probe dubbed "Operation Fast and Furious," 363 have been recovered in the United States and 227 have been recovered in Mexico. That leaves 1,430 guns unaccounted for, the sources said.

NRA Will Sue Obama Administration Over New Gun-Control Measure

Tuesday, July 12, 2011
By Susan Jones
(CNSNews.com) - The National Rifle Association plans to sue the Obama administration over its new gun-reporting requirement in four states bordering Mexico.

On Monday, the Justice Department said it would require firearms dealers in Arizona, California, New Mexico, and Texas to report multiple sales of certain semi-automatic rifles to the same person within a five-day period. The goal is to stop the illegal flow of weapons to Mexican drug cartels, said Deputy Attorney General James Cole.

Senior Official In Justice Department Implicated In Gun-Running Scandal

Posted by Brian
Were Eric Holder and Obama attempting to use the Justice Department as a tool to undermine the 2nd Amendment of the Constitution?  Remember, under Alinski's rules, if you don't have a crisis - create one as a means to further your agenda.  In this case, to create an uproar over the ease at which people, even illegal aliens, can purchase firearms, and even take them to the drug cartels in Mexico. Use the ensuing outrage as a means to outlaw, or at least severly limit, access to and purchasing of firearms by citizens (the militia).
Early accounts are that this scandal reaches at least into the upper parts of the DOJ.  Did anyone in the White House know about the program? If so, who knew and when did they know it?

“Fast and Furious” Blows Sky-High
This morning, there was a stunning development in Congress’s investigation of the Justice Department’s “Fast and Furious” gun-running program: it was revealed that on July 4, Kenneth Melson, the acting director of the Bureau of Alcohol, Tobacco and Firearms and the Obama administration’s intended fall guy in the scandal, broke ranks with his superiors. Without their knowledge, he gave an interview to Darrell Issa’s House Committee on Oversight and Government Reform, accompanied only by his personal attorney. While a transcript of that interview is not yet public, it is clear that he blew the whistle on senior officials in the Justice Department.
This morning, Issa and Senator Charles Grassley released a letter that they sent yesterday to Attorney General Eric Holder. It is explosive, to say the least. You should read it in its entirety; here are some excerpts:

Justice Dept. Obstructing Justice in Gun-Running Probe

DOJ 'Distorted Truth and Obstructed Our Investigation' in Guns-to-Mexico Probe, Lawmakers Say

Wednesday, July 06, 2011
By Susan Jones
(CNSNews.com) - Members of Congress investigating the ATF's botched gun-tracking operation say it now appears that the Justice Department "obstructed" their attempts to find out what happened. They also expressed deep concern about the possibility that the FBI and the Drug Enforcement Agency already knew about -- and may even have been working with -- the people who were smuggling weapons to Mexican drug cartels.  Read More at CNS News

Issa: DOJ Covering Up on Mexican Gun-Running Scandal | CNSnews.com

Darrell IssaImage via Wikipedia
(CNSNews.com) - House Oversight and Government Reform Chairman Darrell Issa (R.-Calif.) told CNSNews.com in an interview that he believes the Justice Department is covering up information relevant to a congressional investigation of an operation in which the department knowingly allowed intermediaries of Mexican drug cartels to purchase guns at licensed firearms dealers in the United States and then get away without being arrested or the guns being retrieved.
