"Schmucky" Schumer - Dems will Change Rules to Fill Judicial Appointments

Senator Chuck Schumer, claiming that Republicans blocked 10th Circuit Court nominee Caitlin Halligan "on specious grounds", said that Democrats will "change the rules" and fill up judicial vacancies "one way or another".

So what was specious about the Republican's blocking Halligans confirmation?

According to the PowerLine blog, Halligan took extreme positions on the meaning of Due Process in the War on Terror, arguing against the use of military commissions in trying non-citizen combatants/terrorists for violations of the laws of war, giving non-citizen terrorists captured on the field of battle the same "rights" as U.S. citizens.  Specious?

Halligan has also supported holding gun manufacturers liable for misuse of the products where someone is injured.  In other words, bankrupt the gun manufacturers by holding them personally liable for damages if someone murders a person with a weapon they manufactured. Once again - specious?

There has also been concern that she has been less than honest with Congress on her views as it regards to the 2nd Amendment.

So, Schumer's claims that the GOP has blocked Halligan for specious reasons actually means that he is upset that he and the leftists can't stack the courts with anti-Constitutional leftist hacks, posing as judges.  Typically, his "solution" is to change the rules of the game so he gets his way, and Republicans are unable to filibuster nominees.  Of course, he will want to change the rules again, once a Republican sit in the Oval Office.  Here's a novel approach: How about Obama nominate someone else who isn't anti-Second Amendment and pro-terrorist!

(CNSNews.com) - Sen. Charles Schumer (D-N.Y.) said Democrats will “fill up the DC circuit one way or another,” even it means changing the rules in the Senate to get nominees confirmed.

At a Mar. 10 dinner event, the New York senator criticized the GOP for rejecting President Barack Obama’s nomination for judge in the 10th circuit, which currently has four vacancies.

“They just rejected on specious grounds a fine New Yorker named Caitlin Halligan for the second time," said Schumer.  "Our strategy will be to nominate four more people for each of those vacancies [on the 10th Circuit Court]. And if they filibuster all of them, it will give those of us that want to change the rules and not allow 60 votes to dominate the Senate but require a talking-filibuster to prevail. So we will fill up the DC circuit one way or another.”

Never let it be said again that Lindsay Graham is a man of principles.  Upset over Rand Paul's filibuster last night over the Obama Administrations refusal to give a yes or no answer to drone strikes on U.S. soil, and demanding an answer from the Obama Administration before allowing a vote on John O. Brennan for CIA Director, Graham stated, “I do not believe that question deserves an answer.”

Graham continued, saying that he was inclined to vote against Brennan prior to the filibuster, but “I am going to vote for Brennan now because it’s become a referendum on the drone program.”  What a man of principle! 

First of all 'Goober', the Brennan nomination is NOT a referendum on the drone program, you idiot!  The filibuster was about holding up the nomination to force this lawless administration to give a straight answer to the questions raised by Attorney General Eric Holder's statement, “It is possible, I suppose, to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States.”  Paul and others asked for clarification from the administration on an extremely troubling statement, and receiving none, prompted the filibuster.

Second. That you would switch your vote on a troubling nominee like Brennan because you are butt-hurt at a colleague smacks of the worst kind of crony, inside Washington politics.  Your behavior, not Rand Paul's, is what the American people are sick of, Mr. Graham.  While Rand Paul was standing on principle on the floor of the Senate for nearly thirteen hours, neither you, nor you butt buddy John McCain, couldn't be bothered to make an appearance on the Senate floor to either support or disagree.  Instead you were having dinner with the very man whose administration continuously stonewalls and lies to Congress and the American people.

I got news for you Senator Graham;  you and John McCain are not the only show in town any more.  Truth be told, your show was more like a freak show anyway.  Like a train wreck, people watched because no one ever knows if you two will stand for the Constitution, or throw the American people under the bus.  More often, it is the latter.  Now there are some new faces in town who actually do stand on conservative principles (Video), and the Constitution, and you feel your power and influence slipping away.  These men, Rand Paul, Mike Lee, Marco Rubio, Tim Scott, Ted Cruz, Ron Johnson, and Jeff Flake, among several others, are the new guard.  Not "new guard" in the sense of just new faces who will continue the disastrous way things are done in Washington now, but new in that they are there to shake up the current power structure and return our government back to its Constitutional roots - one that works for the people, and doesn't lord over them.  

You, Senator Graham, represent the latter, and "we the people" are sick of it!

Harry Reid Proposes New Rule To Handcuff GOP

Saying that the filibuster rule has been "abused" in the past, Harry Reid is proposing changing Senate rules to limit the GOP's ability to filibuster bills.  That Reid is concerned about the abuse of the filibuster, or of rules in general, is laughable.  He has been completely unconcerned regarding not passing a budget in nearly four years, in clear violation of Article I of the Constitution.  Additionally, I doubt that he is concerned that the filibuster has been "abused".  After all, this Senate Rule also benefits the Democrats when they are in the minority. That is, unless Harry Reid believes that the GOP is going to be a minority for an extended period of time, and thus seeks to further weaken their influence in the Senate, ensuring that he and the Dems can push through more legislation that grows the size of government.  This along with a weak-in-the-knees Speaker Boehner in the House could make the next four-plus years extremely damaging to the country.

Senate Majority Leader Harry Reid said Wednesday that he will try to push through a change to Senate rules that would limit the GOP’s ability to filibuster bills.

Speaking in the wake of Tuesday’s election, which boosted Senate Democrats’ numbers slightly, Mr. Reid said he won’t end filibusters altogether but that the rules need to change so that the minority party cannot use the legislative blocking tool as often.
