Rolling back Obamacare will be at the top of many to-do lists for 2011, but a far more significant power grab is underway at the United States Environmental Protection Agency, and blocking it should be the first priority of incoming chairman of the House Energy and Commerce Committee Fred Upton.


The good news is that Upton agrees and has already begun planning to stop the EPA before it can begin the process of asserting effective control over every business and many millions of households in the United States.

In an op-ed Upton co-authored with Tim Phillips, president of Americans for Prosperity, in Monday's Wall Street Journal and again on my radio show yesterday, Upton promised vigorous action by his committee to halt the EPA's attempt to accomplish via backdoor regulation what the Congress could not pass in 2009 or 2010 --a global warming-inspired, job-killing array of federal rules and commands on any operation or system that emits carbon dioxide.  READ MORE HERE --->

SHHH! Don't Tell Anyone, But Death Panels Are Back.

Physicians will be given financial incentives to encourage elderly Medicare patients to enter end-of-life "counselling" ("Do you really want to burden your family with your condition?"). This is something that some physicians now do with seriously ill patients.  My problem with this is when this discussion is brought up because the physician is going to get a financial kickback for doing so.  My question would be: Am I having drugs and procedures withheld due to their expense, and being told how I am being a burden to my loved ones because it's for my own good, or because my physician is getting more money from the system for doing so?  At what point will this start to corrupt some of those in the medical community to ignore their Hippocratic Oath?  Such a slippery slope.  - Brian

Most people don't remember Obamacare's notorious Section 1233, mandating government payments for end-of-life counseling. It aroused so much anxiety as a possible first slippery step on the road to state-mandated late-life rationing that the Senate never included it in the final health care law.

Well, it's back - by administrative fiat. A month ago, Medicare issued a regulation providing for end-of-life counseling during annual "wellness" visits. It was all nicely buried amid the simultaneous release of hundreds of new Medicare rules.

Rep. Earl Blumenauer, D-Ore., author of Section 1233, was delighted. "Mr. Blumenauer's office celebrated 'a quiet victory,' but urged supporters not to crow about it," reports The New York Times. Deathly quiet. In early November, his office sent an e-mail plea to supporters: "We would ask that you not broadcast this accomplishment out to any of your lists . . . e-mails can too easily be forwarded." They had been lucky that "thus far, it seems that no press or blogs have discovered it. . . . The longer this (regulation) goes unnoticed, the better our chances of keeping it."

Doesn't it seem like almost everything is becoming a crime in America now? Americans are being arrested and charged with crimes for doing things like leaving dog poop on the ground, opening up Christmas presents early, not recycling properly, farting in class and having brown lawns. But is it healthy for our society for the police to be involved in such silly things? Every single day the United States inches closer to becoming a totalitarian society. While there are some that would welcome this shift, the truth is that throughout history the societies that have experienced the greatest economic prosperity have all had at least a certain level of freedom. Business thrives when people feel free to live and work. When a government tightens the grip too much many people just start shutting down. Just look at places like North Korea. Even though the rest of the world is sending them huge amounts of food starvation is still quite common in that totalitarian regime. That is why it is so disturbing that it seems like almost everything has become a crime in America now. As we continue to criminalize relatively normal behavior our slide toward becoming a totalitarian state will only accelerate.

One more example of the cronyism in our nation's capital.  The cesspool we call Congress will continue to look the other way on illegal behaviour from its members, both Democrat and Republican, until (or unless) our citizens "clean house" at the ballot box.  While the recent election was a start, the reality is that most of the same faces are still there (Reid, Pelosi, Boxer, Graham, McCain, etc...). Do Our Schools Suck?

This is the kind of knee-jerk overreaction that is reported, seemingly once or twice a week, about a school throwing common sense completely out of the window when dealing with an issue.  Yes, I know. Kids can't bring weapons to school, and safety is paramount.  I get it.  What I don't get is: after an investigation is complete and everything is sorted out, the Principal/School Board/Teacher invariably come to really bad decisions in most of these types of cases.  The decisions always seem to fall as way to lenient, or way to strict. Common sense never enters the equation.  Aside from the punishment, or lack of punishment these kids receive, what concerns me more is the lesson taught to the rest of the kids: Don't use reason and common sense to solve problems. Either react hysterically to relatively small issues, or stick your head in the sand and don't react at all to decisions which have far reaching consequences.  Which leads me back to my original question - Do our schools suck...or what? - Brian

Sanford, N.C. — An athletic and academic standout in Lee County said a lunchbox mix-up has cut short her senior year of high school and might hurt her college opportunities.

Ashley Smithwick, 17, of Sanford, was suspended from Southern Lee High School in October after school personnel found a small paring knife in her lunchbox.
Smithwick said personnel found the knife while searching the belongings of several students, possibly looking for drugs.“She got pulled into it. First, the Republicans reward Michigan Rep. Fred Upton for banning the light bulb, by putting him in charge of energy. Now they reward Illinois Rep. Tim Johnson for voting against farmers’ property rights, by putting him in charge of–you guessed it– farming.


Tim Johnson (RemoveRINOs’ Queen of Hearts) will head the Rural Development Subcommittee of the House Agriculture Committee. While this is far from a stellar position, the irony is just as palpable as in Upton’s case.

The bill Johnson voted against, an overhaul of the Endangered Species Act (HR 3824, 109th Congress), would have reimbursed property owners when the ESA infringes on their ability to develop their property.

Environmental Policies At Root Of High Gas Prices

65% Fewer Refineries Since 1981

Gas prices in the U.S. are the highest in December -ever.  Before you jump on "the oil companies suck" bandwagon, let's look at a few things first:
Refineries:
The United States has not built a new refinery since 1976. In 1981 there were 324 operational refineries in the United States.  Since that time, gas consumption has increased by over 25%.  As of 2008, we have only 149 operational refineries, or 45% of the number of refineries in 1981, which are operating at maximum capacity to meet record demand. We actually import 10% of our refined gasoline from overseas. Loss of even one refinery puts us in a shortage situation. Companies find it nearly impossible to ease this problem though, due to huge costs in getting through all the legal roadblocks thrown up by left-wing environmental groups just to get permits. Oil companies aren't the only victims in this game though. Some of the pressure could be relieved by building more nuclear power plants, which do not use oil, and which do not emit pollutants into the air. But the same roadblocks are put up by these same environmentalists and the EPA to make building cost prohibitive.  This despite that, next to coal, nuclear energy cost is the cheapest to produce - at 7.5 cents per kilowatt hour and which emits no carbon.  Increasing the number of nuclear plants would drive down cost even more. Instead, the environmental wackos at the government are pushing for wind and solar power, which are less efficient and more expensive than nuclear, to solve the nation's power problems.
Oil Exploration in The U.S.:
Oil companies have been hampered in the exploration and drilling of oil by government mandates fueled by environmentalists hysteria over "end of the world" scenarios.  The Santa Barbara spill and the Exxon Valdez were supposed to destroy the eco-system for centuries according to them. Didn't happen.  It's funny, but for those who are so "in tune" with the environment, it is amazing how little credit they give it for its self-healing powers. The California, Alaska, and yes, even the Gulf coasts will be fine. Yet, we have the federal government pushing drilling farther and farther off-shore, making the recovery of oil much more difficult and dangerous.  The BP oil spill in the gulf could have been much less damaging if it had happened in shallower conditions. Capping a well at 500 feet versus 5000 feet is much less challenging, and it's doubtful that it would have taken months to accomplish. Not allowing drilling also has other implications. In Santa Barbara, the site of a spill in the 70's, which caused a drilling moratorium there, still has oil in the water.  It's not from the spill though.  It is from natural seepage through fissures, created by pressure in the sea floor. It is estimated that 10,000 gallons of oil and 3.5 million cubic feet of natural gas seeps up every day. Every three years, the equivalent of an Exxon Valdez, plus the natural emission of hundreds of millions of cubic feet of methane, a global warming gas much more powerful than CO2, naturally seeps to the surface. All of this is easily recoverable.  Yet our government continues to block drilling offshore, in ANWR, and in the Gulf, all the while placing blame for high prices on "Big Oil." This is unfathomable to me.
Big Oil:
We constantly hear politicians rail against "windfall profits".  Big Oil is usually one of the industries on the receiving end of those attacks.  How much profits do the oil companies actually make, though?  We hear a lot of numbers thrown around from the likes of the President, or Hillary Clinton - figures like $150 Billion quarterly revenue. Politicians, looking to score political points, throw out gross revenue collected to convince the public of the greed of these companies.  But is it accurate?  As raw revenue collected, it is.  But as a measure of profits, it is completely misleading.  Oil company profits generally fall around 10%.  This is only slightly higher than the S&P 500 average, and much less than for many other industries.  In some instances, that profit margin is a low as 7.5%.  Compare that to Google, a darling of the left, which posts profit margins of 25%. Why do we not hear the screaming from these same people of their obscene profits? Where are the calls for a special "windfall" profits tax? Don't hold your breath.
Environmentalist Agenda:
Back during the 2008 Presidential campaign, then-Candidate Barack Obama spoke of energy policies which would cause"electricity rates [to] necessarily skyrocket."  The prices we are seeing, and those which are still to come, are a direct result of energy policies which have been followed for decades, driven by a blind allegiance to wrong-headed environmental movement beholden to an ideology whose sole purpose is the weakening of the United States, and redistributing wealth to underdeveloped countries around the world.  In the minds of those on the left, you have too much money, therefore it is their duty to confiscate it from you to give to those whom you have "cheated" out of their fair share. The high prices, supply shortages, and "green" energy initiatives, which are all contributing to the place we now find ourselves, is being driven by an ideology which seeks to separate us from our wealth as a country. It is designed to lower our standard of living to the level of those countries whose citizens have been denied their freedoms and wealth by the likes of "leaders" like Hugo Chavez, Ghaddafi, Mugabi, and other dictators.
The federal government has created this problem through an agenda which is making us poorer, and more importantly, is making us more vulnerable from a national security standpoint.

Last month, 70% of the voters in Oklahoma approved State Question 755, which bans Sharia law (and international law) from being used in the state’s legal system. Almost immediately afterward, CAIR (the Council on American-Islamic Relations) sued to have the vote overturned, based on the bizarre claim that the measure is “unconstitutional.” U.S. District Judge Vicki Miles-LaGrange then sided with CAIR and issued an injunction preventing the measure from taking effect until all lawsuits against it are resolved. Since the suits will likely take years to play out, the new measure (and the will of the voters) will be stymied for the foreseeable future.


Those who oppose Sharia in the United States often argue their point by highlighting how misogynistic, backward, cruel and discriminatory Islamic law can be under most interpretations. And while all that may be true, it is the wrong argument to make. I get so frustrated watching pundits, politicians and bloggers making the weakest argument in what should be a slam-dunk debate that I’ve decided to write this brief outline of what I think should be the prioritized hierarchy of arguments against the use of Sharia in the United States.

In order, these are the arguments that Sharia’s opponents should be using, not just in Oklahoma but anywhere else in the country where the same issue crops up:

President Barack Obama, he of the laser beam focus on the economy, found time to call the Philadelphia Eagles to praise the team for their decision to sign Michael Vick.  Is it any wonder that nobody takes this guy seriously?  He has fellow countrymen (and countrywomen) who have been on unemplyment rolls for 2 years plus, and he is focused on Michael Vick, March Madness, and all things sports.  Does he take his responsibility and his oath seriously.  At this point, I would have to say that he doesn't.  - Brian

The last three weeks I have traveled about, taking the pulse of the more forgotten areas of central California. I wanted to witness, even if superficially, what is happening to a state that has the highest sales and income taxes, the most lavish entitlements, the near-worst public schools (based on federal test scores), and the largest number of illegal aliens in the nation, along with an overregulated private sector, a stagnant and shrinking manufacturing base, and an elite environmental ethos that restricts commerce and productivity without curbing consumption.

During this unscientific experiment, three times a week I rode a bike on a 20-mile trip over various rural roads in southwestern Fresno County. I also drove my car over to the coast to work, on various routes through towns like San Joaquin, Mendota, and Firebaugh. And near my home I have been driving, shopping, and touring by intent the rather segregated and impoverished areas of Caruthers, Fowler, Laton, Orange Cove, Parlier, and Selma. My own farmhouse is now in an area of abject poverty and almost no ethnic diversity; the closest elementary school (my alma mater, two miles away) is 94 percent Hispanic and 1 percent white, and well below federal testing norms in math and English.
