Nowhere in the Constitution does it say that the President has Legislative Powers, but rather can "recommend" to Congress for "Consideration such Measures as he shall judge necessary and expedient".
This President is acting outside of the U.S. Constitution and should be brought up for Impeachment for willfully violating his oath of office.

“When Congress refuses to act, Joe and I are going to act,” Obama said on Tuesday, with Vice President Joe Biden at his side. “In the months to come, wherever we have an opportunity, we’re going to take steps on our own to keep this economy moving.”
